Path to Permanent Residency and/or Citizenship

EB-5 is an immigrant visa and leads directly to a green card. After 2 years of conditional residence, investors file Form I-829 to remove conditions. If the project has met job creation and investment compliance, the green card becomes permanent.

After holding green card status for 5 years, an investor may apply for U.S. citizenship, provided they meet:

  • Physical presence (30 months in the U.S.)
  • Continuous residence
  • English and civics exam (unless exempt)
  • Good moral character

E-2 does not lead directly to a green card, but several transition strategies exist:

  • Investing in an EB-5-compliant project
  • Qualifying for EB-1C (for multinational executives)
  • Marrying a U.S. citizen or employer sponsorship

Dual citizenship is permitted under U.S. law, though applicants should consult their home country’s policies.
