Residency Obligations, Physical Presence & Exemptions
Portugal’s Golden Visa is one of the most flexible in the world regarding physical presence. To maintain residency status, applicants are required to spend a minimum of 7 days in Portugal during the first year, followed by 14 days for each subsequent two-year renewal period. This provision is particularly attractive to global investors with multiple residences or those not seeking immediate relocation.
However, the physical presence requirement takes on increased significance for those aiming for Portuguese citizenship. Applicants must prove five years of legal residency under the Golden Visa, supported by physical presence (not merely permit validity), language integration, and ties to the country. Portuguese courts have recently affirmed that legal residence begins on the date the residence card is issued—not when the application is filed—reinforcing the need for timely presence and compliance.
Exemptions to minimum stay are uncommon but may be granted under exceptional circumstances such as medical emergencies or long-term humanitarian obligations. Applications for exemption must be formally submitted to AIMA and accompanied by substantiating evidence such as hospital records, notarized affidavits, or employer declarations. The probability of success depends heavily on the quality of documentation and the clarity of legal representation.
